Potts Law Firm Files Lawsuit Following Drowning Death of Toddler at Austin Apartment Complex

AUSTIN, Texas, Aug. 31, 2026
AUSTIN, Texas, Aug. 31, 2026 /PRNewswire/ - Attorney Jesse Guerra with the Potts Law Firm has filed a lawsuit on behalf of the family of a 2-year-old child who tragically drowned on Saturday, August 15, 2026 in an apartment complex swimming pool in Austin, Texas.
According to the allegations in the lawsuit, the toddler drowned in an apartment complex swimming pool where the water was allegedly cloudy and there were allegedly no working lights in or around the pool area. The lawsuit alleges that these unsafe conditions created serious safety concerns, including reduced visibility in and around the water, which make it more difficult to identify a child in distress.
The lawsuit seeks accountability for the circumstances surrounding the child's death while also serving as a broader call to action for apartment owners, property managers, and swimming pool operators to take pool safety seriously.
Potts Law Firm hopes this lawsuit will encourage property owners and pool operators to examine their own facilities and take immediate action when a pool cannot be safely maintained. The firm is also urging owners and operators to regularly inspect their pools, promptly address potentially dangerous conditions, ensure qualified and properly trained personnel are responsible for pool maintenance and safety, and restrict access when conditions may present a safety risk to residents and their guests.
"If a pool cannot be kept safe, it should not remain open," said Jesse Guerra, an attorney with Potts Law Firm who focuses on swimming pool safety and drowning cases. "This case is about seeking justice for this family, but it is also about pool safety awareness. We want every apartment owner, property manager, and pool operator to understand how serious their responsibility is. Taking action before a tragedy occurs can save a life."
This case is titled Matthew Kliefoth and Stephanie Slupe, Individually and on Behalf of the Wrongful Death and the Estate of L.K. (Minor) v. Apartment Management Professionals, Ltd., d/b/a AMP, Abel Ruiz, and A Plus Paint & Construction, LLC, Case No. D-1-GN-26-007910 to be heard in the Travis County District Court.
